Terms of Use

By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case “you” refers to that entity. If you do not agree to these Terms, do not use the Services.

AttriByte™ is a privacy-first marketing attribution platform for B2B revenue teams, developed and operated by GTMVP Inc. The Services let you connect your marketing and revenue tools, model multi-touch attribution, and analyze how marketing contributes to revenue — with attribution running against a data warehouse you own. We may add, change, or remove features over time to improve the Services.

To use most features you must create an account and a workspace. You agree to provide accurate information, keep it up to date, and maintain the security of your account credentials. You are responsible for all activity that occurs under your account. The Services are intended for business use by individuals who are at least 16 years old and able to form a binding contract. Notify us promptly of any unauthorized use of your account.

You agree not to:

• Use the Services in violation of any applicable law or regulation.
• Access, tamper with, or use non-public areas of the Services or our systems without authorization.
• Probe, scan, or test the vulnerability of the Services, or breach security or authentication measures.
• Interfere with or disrupt the integrity or performance of the Services, including via automated abuse.
• Reverse engineer, copy, or create derivative works of the Services except as permitted by law.
• Upload malware or use the Services to transmit unlawful, infringing, or harmful content.
• Use the Services to process data you do not have the right to process.

Your data stays yours.

As between you and AttriByte, you retain all rights, title, and interest in the data you connect to, upload to, or generate through the Services (“Customer Data”). AttriByte is designed to run attribution against a data warehouse you own, so your Customer Data remains within infrastructure you control. You grant us a limited, non-exclusive license to access and process Customer Data solely to provide, maintain, secure, and improve the Services for you, and as otherwise described in our Privacy Policy. You are responsible for the accuracy and legality of your Customer Data and for having the necessary rights and consents to provide it to us.

The Services let you connect third-party tools — such as your CRM, ad platforms, and billing system — through managed OAuth. Your use of any third-party service is governed by that provider’s own terms and privacy practices, not these Terms. AttriByte is not responsible for third-party services, and we do not endorse or assume liability for their availability, accuracy, or conduct. You are responsible for maintaining the rights and permissions needed to connect those tools.

Paid Services are billed on a subscription basis according to the plan you select. Unless stated otherwise, subscriptions renew automatically for successive terms, and you authorize us (or our payment processor) to charge your payment method on each renewal until you cancel. Fees are stated exclusive of taxes, which you are responsible for. We may change our prices on prospective notice. Except where required by law or expressly stated, fees are non-refundable. You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

The Services, including all software, design, text, graphics, and other materials we provide (excluding Customer Data), are owned by AttriByte or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Services in accordance with these Terms. All rights not expressly granted are reserved. If you provide feedback or suggestions, you grant us a perpetual, royalty-free license to use them without restriction.

Each party may have access to non-public information of the other party in connection with the Services (“Confidential Information”). The receiving party agrees to use Confidential Information only to perform under these Terms, to protect it with reasonable care, and not to disclose it except to those who need to know and are bound by comparable obligations. This section does not apply to information that is or becomes public through no fault of the receiving party, is independently developed, or is required to be disclosed by law.

The Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. AttriByte does not warrant that the Services will be uninterrupted, error-free, or secure, or that any attribution results will be accurate or meet your expectations. You use the Services at your own discretion and risk.

To the maximum extent permitted by law, AttriByte and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services. Our total aggregate liability for any claim arising out of or relating to these Terms or the Services will not exceed the greater of the amounts you paid to us for the Services in the twelve months preceding the claim or one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

You agree to defend, indemnify, and hold harmless AttriByte and its affiliates from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to your Customer Data, your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.

You may stop using the Services and close your account at any time. We may suspend or terminate your access to the Services if you breach these Terms, if required by law, or to protect the Services or other users. Upon termination, your right to use the Services ends. Because your Customer Data lives in infrastructure you own, you retain access to it subject to your own systems; provisions of these Terms that by their nature should survive termination will survive.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, subject to any mandatory consumer-protection rights you may have in your place of residence.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Services.
